Ein zuverlässiger Rechtsstaat ist Instrument und Ergebnis struktureller Reformen. Dies verabschiedet einen an Steuerungseuphorie anknüpfenden Reformbegriff und problematisiert das Konzept einer Europäischen Integration durch Recht. Der Schwerpunkt des Bandes, dem ein in Athen 2013 stattgefundenes Humboldt-Kolleg zugrunde liegt, wird auf die Legitimität und Effizienz einer Europäischen Implementationsgemeinschaft gesetzt, die mit Hilfe entpolitisierter Instanzen (Schiedsgerichtsbarkeit, Steuerbehörde, Privatisierungsfonds) Staatsveränderungen in die Wege leitet, die ihre Umverteilungs- und Nebenwirkungen in Rechnung stellen können. Zentrale Bedeutung kommt der Reflexion auf das Spannungsverhältnis von Kreditvergabe-Konditionalität und $aOwnership$z der Reformen zu. Der Band arbeitet die Anforderungen heraus, die dieses Spannungsverhältnis an das Recht, an eine geeignete juristische Methodik sowie an die Wiederherstellung von Vertrauen in den Staat im Innen- und Außenverhältnis stellt.»State Reform for a Better Europe«Reform has become a buzzword in Europe, especially after the advent of the financial crisis. A crisis that has been imported from the other side of the Atlantic but stayed on the European continent for longer than in the US, and has sustainably changed governance systems at the EU and the Member State level. This book takes a different point of view in comparison to similar efforts that describe the causes and propose ways out of the crisis, and suggests looking at the EU Member State level, namely at the need and possibility of reform of the EU Member States as a way out of the crisis. The book presents the results of a Humboldt-Kolleg organized in Athens in May 2013 with participants from all over Europe, primarily from Germany and Greece.
