La finalità di questo testo è di aiutare gli studenti a maturare, attraverso l’apprendimento basato sul metodo casistico-problematico, una propria riflessione critica sull’evoluzione dei diritti (o del diritto) della personalità. In una società in cui la mercificazione e la datificazione si associano alla sorveglianza e quest’ultima diventa pervasiva si moltiplicano le minacce alla persona nelle sue dimensioni individuale e collettiva. In gioco è la tenuta delle società democratiche. In che misura il diritto civile (il diritto dei privati) può contribuire a contrastare o ad assecondare queste minacce? Alcune risposte parziali dovrebbero emergere nella parte quarta del libro. ⛔️ The purpose of this text is to help students to mature, through learning based on the casuistic-problematic method, their own critical reflection on the evolution of the rights (or law) of the personality. In a society in which commodification and datafication are associated with surveillance and the latter becomes pervasive, the threats to the individual and collective dimensions of the person multiply. At stake is the resilience of democratic societies. To what extent can civil law (the law of private individuals) contribute to countering or supporting these threats?
